“The Germoglio company, with Head Office in Conegliano – Treviso , Italy , has summoned the firm L.A.L. srl, with Head Office in Loreto – Ancona , Italy , before the Court of Venice, Special Section for the commercial rights and the intellectual property, against the illegitimate use of the Germoglio trade mark in their catalogue.

Germoglio notifies its clients that it has never granted L.A.L. srl any sole agency all over the world and that it has stopped the supplying of the Germoglio St. Benedict's Crosses since 2001.

 

The firm L.A.L. srl bound itself in front of the judge as follows:

 

  • Art.1 L.A.L. srl binds itself to not use the term Germoglio in connection with religious items and images reproducing original products by Germoglio.
  • Art.2 L.A.L. srl binds itself to retire from the market and to destroy within December 31 st 2005 the material resulting in violation of the commitments contained in the above Art. 1, and to notify its customers about the changing of the catalogue and of the price list in use as long as 2004 with the 2005 catalogue and 2005 price list.

  • Art.4 In case of violation of the commitments contained in Art. 1, L.A.L. srl binds itself to pay the amount of € 250.00 for each act by way of penalty unless compensation for greater damage is due.
  • Art.5 Germoglio waives any cause of action or claim regarding the facts under precautionary claim with respect to the commitments by L.A.L. srl, and their punctual execution.”

With this note the firm Germoglio notifies its clients about the truth of the facts in order to defend the Germoglio trade mark from every abuse.
